Terms of Service

These Terms of Service ("Terms") govern your use of ShowBinder ("the Service"), operated by ShowBinder ("we", "us", "our"). By creating an account or using ShowBinder, you agree to these Terms.

If you do not agree to these Terms, please do not use the Service.

1. The Service

ShowBinder is a platform that allows Pokémon trading card vendors ("Vendors") to publish live card inventories online, accessible to buyers ("Buyers") via a QR code or URL. ShowBinder acts as a platform only — we are not a party to any transaction between Vendors and Buyers.

ShowBinder is currently in beta. Features may change, and the Service is provided on a best-effort basis without guaranteed uptime or availability.

2. Vendor Accounts

To use ShowBinder as a Vendor, you must create an account with a valid email address. You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring the accuracy of the inventory information you publish
• Complying with applicable laws regarding the sale of trading cards in your jurisdiction

You must be at least 16 years old to create an account.

3. Acceptable Use

You agree not to use ShowBinder to:

• List counterfeit, altered or misrepresented cards
• Engage in deceptive, fraudulent or misleading practices
• Upload content that is illegal, offensive or infringes the rights of others
• Attempt to access, disrupt or reverse-engineer the Service
• Use automated scripts to scrape or abuse the platform
• Impersonate another vendor or individual

We reserve the right to suspend or terminate accounts that violate these terms without notice.

4. Inventory Content

You retain ownership of the inventory data you upload. By publishing it on ShowBinder, you grant us a non-exclusive, royalty-free licence to store, display and transmit that data to Buyers as part of providing the Service.

You are solely responsible for the accuracy of prices, conditions, grading information and stock levels. ShowBinder does not verify listing accuracy and accepts no liability for disputes arising from inaccurate listings.

5. Transactions

ShowBinder is a discovery and inventory tool only. We do not process payments, facilitate transactions or act as an escrow. Any purchase or trade agreed between a Vendor and Buyer is a private arrangement between those parties. ShowBinder accepts no liability for failed transactions, disputes, lost items or payment issues.

6. Intellectual Property

Pokémon, all Pokémon character names, and related imagery are trademarks of Nintendo / Creatures Inc. / GAME FREAK inc. ShowBinder is an independent product and is not affiliated with, endorsed by or associated with The Pokémon Company or Nintendo.

Card images displayed via ShowBinder are sourced from TCGdex, a community database. Vendors are responsible for ensuring their use of card images complies with applicable copyright laws.

The ShowBinder name, logo and codebase are owned by ShowBinder. You may not reproduce, copy or repurpose these without written permission.

7. Availability & Beta Status

ShowBinder is currently in beta. This means:

• The Service may be unavailable for maintenance or updates at any time
• Features may be added, changed or removed without notice
• We do not guarantee data persistence indefinitely, though we will provide reasonable notice before any data deletion
• The Service is provided free of charge during the beta period

8. Limitation of Liability

To the maximum extent permitted by law, ShowBinder shall not be liable for:

• Any loss or damage arising from your use of or inability to use the Service
• Any transactions, disputes or losses between Vendors and Buyers
• Any loss of data or inventory information
• Any indirect, incidental or consequential loss

Our total liability to you for any claim shall not exceed the amount you have paid to us in the 12 months prior to the claim (which during the free beta period is £0).

9. Termination

You may delete your account at any time via your vendor dashboard or by contacting us. We reserve the right to suspend or terminate your account for breach of these Terms or for any conduct we reasonably consider harmful to the Service or its users.

Upon termination, your inventory will no longer be publicly accessible. Data deletion follows the schedule in our Privacy Policy.

10. Changes to These Terms

We may update these Terms as the Service evolves. We will notify users of material changes via the ShowBinder website. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
